1. Who we are

This Privacy Notice explains how Aequa and Company (H.K.) Limited ("Aequa & Co.", "we", "us") collects, uses and protects your personal data when you visit aequaandco.com, buy from us, sign up for emails or texts, or contact us. We handle your personal data in line with applicable data protection laws.

This notice should be read with our Terms of Service.

2. What we collect

We only collect what we need to sell to you, deliver your order and stay in touch if you want us to. Giving us your data is voluntary, but we can't take an order without your name, contact and delivery details.

Contact details, such as your name, email, phone number and addresses, which you give us.
Order information, such as what you buy, sizing and personalisation details, and returns, from you and our order records.
Payment information, limited to details such as payment status, from our payment providers. We don't store full card numbers.
Account information, such as login details and order history, if you create an account.
Marketing preferences, such as your email and SMS choices, from you and our marketing providers.
Communications, such as messages, reviews and content you send us.

We don't collect government ID numbers, and we don't ask for sensitive data such as health, religion or ethnicity.

3. How we use it

To fulfil orders: process payments, ship and track deliveries, handle engraving, resizing, bespoke work, returns and exchanges.
To run your account and answer your questions.
To send marketing — emails and texts about new collections, private events, offers and cart reminders — only if you've opted in. You can opt out at any time (section 5).
To show relevant ads on platforms like Instagram, Facebook and Google, unless you opt out (section 6).
To improve the site by understanding how people browse and shop.
To prevent fraud and keep the site secure.
To meet legal obligations, such as tax, accounting and customs records, and to respond to lawful requests from authorities.

We don't sell your data for money, and we don't give it to other companies for their own marketing.

4. Who we share it with

We share personal data only with companies that help us run the business, and only what each one needs. They're contractually required to protect it and use it only for the services they provide to us. These companies include Shopify, shipping couriers, ad and email providers, Gemological Institute of America (GIA) and professional advisers. We may also disclose data when required by law, a court order or a government authority, or to protect our rights or prevent fraud. If our business is sold or restructured, customer data may transfer to the new owner under this notice.

5. Email and SMS marketing

We send marketing emails and texts only if you've opted in. We use Brevo to send them and to keep a record of your consent, including when and how you signed up.

Email: every marketing email has an unsubscribe link.
SMS: to opt out, reply STOP to any text from us, or text STOP to +1 866 407 3722. You'll receive one confirmation text and no further texts, including order updates. For help, reply HELP to any text, text HELP to +1 866 407 3722, or email info@aequaandco.com.
Your phone number is used only to send the texts you signed up for. We don't sell it, and we don't share your phone number, SMS opt-in or consent records with third parties for their own marketing.
Order updates (confirmations and shipping) are sent by email, and by text if you've chosen that.

Under Hong Kong law, we won't use your data for direct marketing without your consent, and we stop as soon as you ask.

6. Cookies and advertising

We use cookies and similar technologies to run the site, understand how it's used, and show and measure our ads. You can manage cookies through our cookie banner, where shown, or your browser settings.

Some US state laws treat ad-related tracking as "selling" or "sharing" personal data. To opt out, email info@aequaandco.com with "Opt out" in the subject line.

7. Retention and security

We keep personal data only as long as we need it for the purposes in this notice, including to meet legal, tax and accounting requirements and to keep a record of your marketing choices.

We take reasonable steps to protect your data and never store full card numbers. If a breach affects your data, we'll let you know where the law requires.

8. Your rights

Depending on where you live, you may have the right to access, correct or delete your personal data, to receive a copy of it, to opt out of marketing, and to opt out of targeted advertising. We won't treat you differently for using these rights. We don't sell personal data for money, and we don't knowingly sell or share data of anyone under 16. To make a request, email info@aequaandco.com. We may need to verify your identity first, and we'll respond within the time the law requires.

9. Other sites, changes and contact

Third-party sites. Our site links to others, such as Instagram. We don't control their privacy practices, so please read their policies.

Changes. We may update this notice. The "Last updated" date shows when it last changed. For material changes, we'll post a notice on the site or email account holders before they take effect.
